Cell origin & purchasing requirements

Pack assembly: United States. Components may be internationally sourced. The answers below apply to the stated criterion, not to every government purchase or a complete aircraft.

AMPRIUS SA08 — origin & eligibility

Cell manufacturing country: China.

  • Requirement: no China-manufactured cells. No. These cells are manufactured in China.
  • FY2020 NDAA §848, as amended — does cell origin alone trigger its listed-component restriction? No. Battery cells are not among the enumerated components. This is not a determination of compliance with all of §848 or approval of the complete UAS.
  • FY2024 NDAA §154 — is this cell brand explicitly named? No. The provision names CATL, BYD, Envision, EVE, Gotion and Hithium, plus their successors. It also covers batteries for which those entities provide a majority of components. Not currently offered as compliant with the full §154 requirement. If your purchase requires it, contact us before ordering to discuss a documented configuration; the brand name alone does not establish compliance. The statutory restriction begins October 1, 2027; programs may apply it earlier.
  • Drone Dominance Phase II / III — non-covered-country pack assembly criterion: Meets. This pack is assembled in the United States. This answer covers pack assembly only; entity screening and applicable electronics/BMS requirements remain separate.
  • Drone Dominance Phase III preferred (February 2027) / Phase IV minimum (August 2027) — cell sourcing: Does not meet the cell-country requirement. These cells are manufactured in China.
  • Drone Dominance Phase IV preferred — U.S.-manufactured cells: Does not meet. These cells are not manufactured in the United States.
  • FY2026 NDAA §842 / 10 U.S.C. §4865 — documented eligibility: Not currently offered as compliant with this requirement. If your purchase requires it, contact us before ordering to discuss a documented configuration. Availability must be confirmed in writing. It covers functional cell components and technology, with exceptions and waivers. Statutory applicability begins January 1, 2028 for new acquisition programs, January 1, 2029 for standard batteries and January 30, 2031 for existing programs, for covered contracts entered after December 18, 2025. Program requirements can apply earlier.

Buying for a restricted program? If your purchase requires documented §154, §842 or full Drone Dominance eligibility, do not place an online order on the assumption that it qualifies. Contact sales@upgradeenergytech.com before purchasing. Include the product, quantity, applicable provision or program phase and delivery date. We must establish the allocated cell model, manufacturing route and required supplier evidence before representing the order as eligible.

Read the sourcing guidance and statutory references · Drone Dominance framework, July 23, 2026, battery row on page 4.

Reviewed October 26, 2026. No universal NDAA certification is claimed. Drone Dominance criteria are program-specific and may change.
